As of August 1st, 2001 this is the terms of agreement
statement for use at DJ Approved.Com. These terms of agreement
constitute the entire contract between DJ Approved and myself.
DJ Approved is in no way connected to It's Your Party DJ or any other DJ
entertainment company.
My use of DJApproved.Com’s Web site (including site’s affiliated with the
site) and all information, products, listings, subscriptions and services on
the site are subject to the binding legal terms set forth below in this
agreement. We may update these Terms at any time without any notice. BY USING
THE SERVICES, I AGREE TO EACH OF THE TERMS SET FORTH BELOW. IF I DO NOT AGREE
WITH ANY TERM OR CONDITION SET FORTH BELOW, I AM NOT AUTHORIZED TO USE THE
SERVICES FOR ANY PURPOSE. I UNDERSTAND THAT DJ APPROVED’S SERVICE MAY NOT MEET
MY REQUIREMENTS AND/OR EXPECTATIONS; MAY NOT BE UNINTERRUPTED, TIMELY, SECURE,
OR ERROR FREE.
If you have questions about services or
concerns regarding the information details the DJ you selected, you should first
contact Jeff Doyle at It's Your Party DJ directly by sending an email to itsyourpartydj@aol.com
or calling 602-923-9000. If you do not receive acknowledgment
of your inquiry or your inquiry has not been satisfactorily addressed, you
can then file a complaint about It's Your Party DJ online by
Clicking Here. DJ Approved makes no guarantees that the information
provided to DJ Approved is as stated. DJ Approved will investigate
and follow up if you feel that a DJ has misrepresented himself/herself. To contact DJ Approved directly send an email to
admin@djapproved.com.
DJApproved.Com allows users looking for entertainment to search this site free
of charge. However, in order to access the Site, all users need to establish
an account with an Internet service provider. Users will also need equipment
to access the site such as a computer modem or other communication device. I
agree to pay for all the hardware and software services costs needed to access
the Site and use the Services. DJApproved.Com is not responsible for any of
these costs.
I understand that the DJ Approved service is provided “AS-IS” and that DJ
Approved assumes no responsibilities for the timeliness, deletion,
miss-delivery or failure to store or print any user information
I herby authorize DJ Approved to release information about my event to the DJ
Company I have selected.
I agree to provide accurate information to DJ Approved and the entertainment
company(s) I contact. Any intentional misrepresentation of information.
I agree not to use this service to upload, post, email, transmit or otherwise
make available: (1)any unsolicited or unauthorized advertising, promotional
materials, “Spam Mail”, “Chain Letters”, “Pyramid Schemes”, or any other form
of solicitation. (2) any content that I do not have a right to make available
under any law or under any contractual or fiduciary relationships (such as
inside information, proprietary and confidential information learned or
disclosed as part of employment relationships or under nondisclosure
agreements). (3) any content that infringes any patent, trademark, trade
secret, copyright or other proprietary rights of any party. (4) any material
that contains software viruses or any other computer code, files or programs
designed to interrupt, destroy or limit the functionality of any computer
software or hardware or telecommunications equipment.
In the event that I file a complaint made about an entertainer, DJ approved
will contact me and the company to try help settle the dispute. If there was a legitimate
complaint made, DJ Approved will consider removing the listing of that company.
DJ Approved, it's owner, employees, investors, agents, assigns, and affiliates
shall not be liable for, and release from and waive all claims for any loss of
profits, direct or indirect, special or consequential damages or any other
loss incurred or suffered by me as a result of (1) my violation of the terms
of this agreement (2) the promotion and operation of my company (3) any
incorrect or wrong information provided by me (4) any incorrect or wrong
information provided by DJ Approved (5) any incorrect or wrong information
provide by a website user or outside user (6) DJ Approved website technical
difficulties (7) the creditworthiness or reliability of the leads generated by
the DJ Approved website and/or staff.
If a provision of these terms of agreement is held to be unenforceable or
invalid, such provision shall be reformed only to the extent necessary to make
it enforceable, and the balance of the terms of agreement will remain in full
force and effect.
Due to the global nature of the internet, I agree to comply with all local
rules regarding online conduct and acceptable content.
I agree not to reproduce, duplicate, copy, sell, resell or exploit any
information on this website for any commercial or personal purposes. I am not
authorized to modify, reformat, copy, display, distribute, transmit, publish,
license, create derivate works from, transfer or sell any information,
products or services obtained from the DJ Approved website.
I agree not to harass, threaten or abuse other people when using the DJ
Approved website in any matter.
I agree not to interfere with other’s use of the site and will not stalk,
harass or repeatedly contact another user.
I agree not to attempt to harvest any company names, email addresses and any
other material for commercial use.
DJ Approved reserves the right at any time to modify, discontinue, temporarily
or permanently remove the DJ Approved service and listings.
I understand that the DJs listed in this directory are not in
any way employed by DJ approved. We do not recommend DJs, we simply
verify the information submitted to us. We are not in anyway responsible
for the entertainment you hire. We highly recommend previewing your DJ
in person before making a final decision.
I understand that all information, data, text, software, sound, music,
photographs, video, graphics, messages or other materials, whether publicly
posted or privately transmitted, are the sole responsibility of the person
from which such material originated. This means that I, and not DJ Approved,
are entirely responsible for all content you submit, post, email or otherwise
make available. DJ Approved does not guarantee the accuracy, integrity and or
quality of such material. I understand that by using the service and visiting
sections of the website that are updated by website users, I may be exposed to
material that could be offensive, indecent or objectionable. Under no
circumstances will DJ approved be liable in any way including, but not limited
to, any errors or omissions in any material, or for any loss or damage of any
kind incurred as a result of the use of any content posted, emailed,
transmitted or otherwise made available by the DJ Approved service.
I understand that my communications or business relations with or in
participations of advertisers found on the DJ Approved website are solely
between myself and the advertiser. DJ Approved shall not be responsible or
liable for any loss or damage of any sort between I and the advertiser.
At DJ Approved we respect the property of others and we ask you to do the
same. We support the Digital Millennium Copyright Act enacted by Congress on
October 28, 1998. If you believe that someone else’s or your information has
been copied in a way that constitutes copyright infringement, or intellectual
property rights have been otherwise violated, please contact us and we will
attempt to assist in the matter. If you find a DJ that is misrepresenting
him/herself please contact us.
These terms of agreement will be governed by and construed in accordance with
the laws of the State of California. Except as set forth in the DJ Approved
terms of agreement, all disputes and claims relating to DJ Approved, it's
products or services, the rights and obligations of myself, or any other
claims or causes of action relating to the performance of DJ Approved shall be
settled in Placer County, California. |
